Drunken binman assaulted policewoman

A drunken binman assaulted a policewoman who stopped him falling over, Burnley magistrates were told.

The court heard Lee Gareth Smalley (28) had pushed the officer hard in the left shoulder after he had been taken to his mother’s address. Smalley, who was continually swearing, had almost lost his footing and officers had put out their arms to prevent him taking a tumble.

After the incident last October 3rd, Smalley had been given a caution, on condition he attended Inspire, the alcohol and drugs treatment service, and paid £50 compensation, but he didn’t do either.

Smalley, of Railway Terrace, Brierfield, admitted being drunk and disorderly on Netherfield Gardens, Brierfield, and police assault. The defendant, who had no previous convictions, was fined £125, with £85 costs and £50 compensation.

Glen Smith (defending) said the refuse collector’s behaviour had been “ boorish.” The solicitor added: “He was not aware of what he was doing.”
