Abusive Burnley man has ASBO extended

A Burnley man is now banned from swathes of Pendle after police successfully extended the length and scope of his anti-social behaviour order.

Paul Manley (47), of Forest Street, Burnley, is now prohibited from entering Nelson, Colne, Brierfield and Reedley for two years, other than to travel through on public transport.

Chris Kehoe, on behalf of the police, told Burnley Magistrates’ Court alcoholic Manley was a “gentleman without portfolio”.

Mr Kehoe said it was “reasonable and proportionate” to extend the geographic scope as it was “necessary to protect people in the area of Pendle from his anti-social behaviour”.

Magistrates agreed to grant the extension, but did not include the Lomeshaye Industrial Estate, Barrowford and Higherford, which were part of the police’s application.

The Bench had earlier heard from PC Karen Isherwood, who was applying for the extension, to ban him from Burnley right through to Colne which she described as his “corridor of access”.

She told the court Manley’s anti-social behaviour was “continuous shouting and swearing, more often than not under the influence of alcohol” and businesses faced a “constant battle”.

Asked by Mr Kehoe what it would mean if the order was not extended, PC Isherwood said: “He would continue to behave as he does now, with impunity.”

David Leach, representing Manley, who was not present in court, questioned the need for a “wholly wrong” blanket ban, adding it was a “ludicrous proposition”.

Mr Leach had argued for more focused areas where Manley’s behaviour had been a problem, including outside the Co-op and Spar in Brierfield, the Lord Nelson and Station Hotel pubs in Nelson, and the Asda supermarket and Admiral Lord Rodney pub in Colne.

Mr Leach urged the court not to make an order “for the sake of convenience”, but Mr Kehoe said a ban from whole areas would be “simple to understand”.

Police were keen to renew Manley’s existing two-year anti-social behaviour order from January 2013, due to expire next month, which banned him from entering Albert Road and Market Street, Colne.

Under the existing order, Manley was also banned from Burnley’s inner ring road (except for pre-arranged appointments), Asda, Tesco, TK Maxx, the Anchor Retail Park and Sainsbury’s in Burnley and Turf Moor for two hours either side of kick-off on a matchday. The areas of Burnley remain the same with the new order.

Speaking after the hearing, PC Isherwood said: “I’m very happy with the outcome for the residents of Pendle. It gives Mr Manley a very clear message he is not welcome.

“It provides protection for innocent members of the public and acknowledges they have been victims of his persistent anti-social behaviour.

“The previous order which covered areas of Burnley and a small part of Pendle was breached approximately 30 times. This new order is an improvement and we will continue to take appropriate action if there are further breaches.”
