David Fallows (60) had been seen on Casterton Avenue at around 7pm, when youngsters were still out in the area.

Fallows admitted being drunk and disorderly when he appeared before Burnley magistrates. The Bench was told he had an alcohol problem and was getting help from the Friendship Centre, in Duke Bar, Burnley. He currently lives at Sky Crescent, Blackburn.

Fallows had previous convictions for being drunk and disorderly. He was given a 12 month conditional discharge and was ordered to pay £85 costs, a £15 victim surcharge and a £150 criminal court charge.

Mr Nick Cassidy (defending) said Fallows had an issue with alcohol. ”He fully accepts the prosecution case against him,” said Mr Cassidy.

“He wasn’t aware there were children about, but he knows it’s a very unpleasant incident for anybody to witness.”

Bench chairman Lynn Kemp told Fallows: “It’s sad that you have got an issue with alcohol, but it’s good to hear you are getting some help and assistance.”
