Jason McQuoid (25) who runs Vogue on Hammerton Street, received the discretionary ban instead of six to eight points on his licence, at the town’s magistrates court.

He had admitted driving a Chrysler without insurance on Hammerton Street in the early hours of May 15th last year.

McQuoid had been given a suspended jail term, but was spared a ban on September 8th when he was convicted of driving while disqualified.

The defendant had claimed exceptional hardship on the grounds he would lose his business, which others also depended on for their livelihood, if he was ordered off the road.

The court was told McQuoid’s mother had a sandwich shop in Burnley, didn’t drive and he also helped her out by running her around.

The latest hearing, on Thursday, was told he could not use that argument against a ban again.

Instead, his solicitor urged the bench to impose a discretionary disqualification rather than points as McQuoid had been left with points on September 8th and would be facing a ban (of six months) if he got some more for not being insured.

The defendant, of Hammerton Street, was told by bench chairman Mr Christopher Creelman: “We feel that really we have got a tidying up matter here.”

McQuoid was fined £200 and told to pay £85 costs and a £30 victim surcharge.

Mr Creelman warned him: “If you drive, don’t expect any leniency at all. You are basically on a knife edge.”
