Burnley mechanic over cannabis limit in car

A mechanic, said to be giggling in the driver’s seat of a parked car, was more than three times the cannabis limit when spoken to by police, a court heard.

Adam Windle had been found slouching in his seat by two PCSOs who had come across the vehicle and who described him as “under the influence.”

Windle, who had two passengers, was discovered on Rowley Lane, Burnley, at about 8-45pm, last September 11th.

Prosecutors told Burnley magistrates the 20-year-old handed his keys over when police officers arrived and they said he was sluggish and drowsy and seemed to be smiling and giggling.

A test proved positive for cannabis and at the police station, a sample showed 6.5 microgrammes of delta-9-tetrahydrocannabinol per litre of blood. The amount allowed is two microgrammes. The defendant had no previous convictions.

Mr John Rusius (defending) said the two passengers were found to be smoking cannabis. When he was searched, Windle did not have the drug on him, but the passengers did.

The solicitor added: "It's been suggested he was giggling. That was simply nerves and nothing else. He is a mechanic and needs his licence for that, obviously.”

The defendant, of Heather Bank, Burnley, admitted being in charge of a vehicle with a proportion of a specified controlled drug above the specified limit. He was fined £140, with £85 costs and a £32 victim surcharge and was given 10 penalty points.
